Terms of Service

Thanks for reading with us. These terms explain what you can expect from Storyish, and what we expect from you. We’ve tried to keep them readable; the headings are there to help you find what you need.

1. Agreeing to these terms

These Terms of Service (the “Terms”) are a binding agreement between you and Storyish (“we”, “us”). They cover the Storyish iOS app, the website at https://storyish.app, and any related services we offer (together, the “Service”).

Storyish is currently operated by an individual developer based in Arizona. “Storyish”, “we” and “us” mean that operator and, once it is formed, the company that takes over the Service. We will let you know when that happens; these Terms will continue to apply.

By creating an account or using the Service, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Section 18 contains a binding arbitration agreement and a class action waiver. They affect how disputes between you and us are resolved. Please read them.

2. Who can use Storyish

You must be at least 13 years old, or older if the law where you live sets a higher minimum age for using online services without a parent’s consent. If you are under 18, you confirm that a parent or guardian has reviewed and agreed to these Terms with you.

You may not use the Service if we have previously banned you, or if you are barred from receiving services under applicable law.

3. Your account

You sign in with Sign in with Apple or Google. You are responsible for activity on your account and for keeping access to the sign-in method secure. Tell us promptly at [email protected] if you think someone else has accessed your account.

Your username and display name must not impersonate another person, infringe someone’s rights, or be offensive. We may reclaim or change a username that breaks these Terms.

4. Your content

“Your Content” means anything you add to the Service: ratings, reviews, notes, shelves, reading sessions, club posts and messages, replies, photos, profile details and imported reading history.

You own Your Content. To run the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, display, adapt (for example, resizing an image) and distribute Your Content, solely to operate, improve and promote the Service. That includes showing it to the audience you chose: public content to other readers, club content to club members, and private notes to no one but you.

The license ends when you delete the content or your account, except where Your Content has been shared with others and they have kept a copy (for example, quoted in a reply), or where we must keep it for legal reasons.

You confirm that you have the rights needed to post Your Content and that it does not break these Terms or the law. Keep quotations from books short and attributed; do not post substantial portions of copyrighted works.

5. Community rules

Storyish is a place to talk about books. To keep it that way, you agree not to post or do anything that:

  • harasses, threatens, bullies or targets another person, or promotes hatred based on identity;
  • is sexually explicit, depicts minors in a sexual way, or glorifies violence or self-harm;
  • is spam, a scam, deceptive advertising, or artificially inflates ratings or reviews;
  • reveals someone else’s private information without their consent;
  • infringes intellectual property, including sharing pirated books or links to them;
  • impersonates a person or organization, or misrepresents your affiliation with one;
  • is illegal, or encourages others to break the law.

Mark plot spoilers with the spoiler tag. Reviews should reflect your own honest experience of the book.

Club owners and moderators may set extra rules for their clubs, and may remove posts or members within their club. Those rules cannot override these Terms.

You can report posts, messages and profiles in the app. We review reports and may remove content, restrict features, or suspend accounts at our discretion. We are not obliged to monitor the Service, and we are not responsible for content posted by other users.

6. Acceptable use

You agree not to:

  • scrape, crawl or bulk-collect data from the Service, including the book catalog or user profiles;
  • access the Service by automated means other than the app and website we provide;
  • reverse engineer, decompile or attempt to extract the source code of the app, except where the law allows;
  • probe, test or bypass our security or rate limits, or interfere with the Service’s operation;
  • use the Service to build a competing product, or resell access to it;
  • create accounts in bulk, or use another person’s account without permission.

7. Storyish Plus and payments

Storyish Plus is an optional subscription that unlocks additional features. Prices are shown in the app before you buy. Subscriptions are sold and billed by Apple through your App Store account, and Apple’s terms and payment policies apply to the purchase.

  • Renewal. Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends.
  • Free trials. If a plan includes a free trial, you will be charged when the trial ends unless you cancel before then.
  • Cancelling. Manage or cancel from your Apple ID subscription settings. Cancelling stops the next renewal; you keep Plus until the current period ends.
  • Refunds. Apple handles refund requests for App Store purchases. We cannot issue refunds directly.
  • Price changes. We may change prices. Apple will notify you in advance where required, and you can cancel before the new price applies.

If your subscription ends, nothing you created is deleted. Anything above the free limits, such as extra club channels or private clubs, becomes read-only until you resubscribe or bring it within the free limits.

8. Our content and the book catalog

The Service, including its design, software, illustrations, logos and the Storyish name, belongs to us or our licensors and is protected by law. We give you a personal, non-exclusive, non-transferable, revocable license to use the app on Apple devices you own or control, as permitted by these Terms and the App Store’s usage rules.

Book information such as titles, authors, descriptions and cover images comes from publishers and third-party catalog sources. It is provided for reference and may contain errors. Covers and titles remain the property of their respective owners.

9. Feedback

If you send us ideas or suggestions, we may use them without any obligation to you. You are never required to send feedback.

10. Third-party services

The Service relies on and may link to services we do not control, such as Apple, Google and bookstores or library sites. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them.

We respect the rights of authors and publishers. If you believe content on the Service infringes your copyright, email [email protected] with:

  • your contact details and a signature (typed is fine);
  • the work you believe is infringed;
  • where the material appears in the Service, precise enough for us to find it;
  • a statement that you have a good-faith belief the use is not authorized;
  • a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner.

We will remove material that is the subject of a valid notice and may terminate the accounts of repeat infringers. Knowingly false claims may lead to liability.

12. Apple App Store terms

If you use the iOS app, the following also applies:

  • These Terms are between you and Storyish, not Apple. Apple is not responsible for the app or its content.
  • Apple has no obligation to provide maintenance or support for the app.
  • If the app fails to meet an applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation.
  • Apple is not responsible for claims relating to the app, including product liability, legal or regulatory compliance, consumer protection, or intellectual property claims. We are responsible for those, as set out in these Terms.
  • You confirm you are not located in a country subject to a U.S. government embargo, and you are not on a U.S. government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.

13. Suspension and termination

You can stop using the Service at any time and delete your account from Settings in the app. Deleting your account does not cancel an App Store subscription; cancel that separately with Apple.

We may suspend or terminate your access if you break these Terms, if we are required to by law, or if your use creates risk or harm for other readers or for us. Where it is reasonable, we will tell you why.

Sections that by their nature should survive termination, including ownership, disclaimers, limitation of liability, indemnity and dispute resolution, will survive.

14. Changes to the Service and these Terms

We are always improving Storyish, so features may change, and some may be removed. We may also update these Terms. If a change is material, we will give notice in the app or by email before it takes effect.

Continuing to use the Service after the change takes effect means you accept the new Terms. If you do not agree, stop using the Service and delete your account.

15. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT BOOK INFORMATION, STATISTICS OR OTHER CONTENT WILL BE ACCURATE. SOME JURISDICTIONS DO NOT ALLOW THESE EXCLUSIONS, SO THEY MAY NOT ALL APPLY TO YOU.

16. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, STORYISH WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE, EVEN IF WE HAVE BEEN TOLD SUCH DAMAGES ARE POSSIBLE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR US$50.

Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud or for death or personal injury caused by negligence.

17. Indemnity

To the extent permitted by law, you agree to defend and indemnify Storyish against claims, losses and costs (including reasonable legal fees) arising from Your Content, your misuse of the Service, or your breach of these Terms.

18. Disputes, arbitration and governing law

Talk to us first. Most problems can be solved quickly. Before starting a formal dispute, email [email protected] with a description of the issue and what you want. We will both try in good faith to resolve it within 60 days.

Arbitration. If we cannot resolve it, you and Storyish agree that any dispute arising out of or relating to these Terms or the Service will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration may be held by video or phone, or in the county where you live. Judgment on the award may be entered in any court with jurisdiction.

Class action waiver. Claims may only be brought individually, not as a plaintiff or class member in any class, consolidated or representative proceeding.

Exceptions. Either party may bring an individual claim in small claims court, and either party may seek an injunction in court to protect its intellectual property.

Opting out. You may opt out of this arbitration agreement by emailing [email protected] within 30 days of first accepting these Terms, with your name, username and a clear statement that you opt out.

Governing law. These Terms are governed by the laws of the State of Arizona and applicable U.S. federal law, without regard to conflict of law rules. Any claim not subject to arbitration will be brought exclusively in the state or federal courts located in Arizona. If you live in the European Union or the United Kingdom, you also keep the protection of the mandatory consumer laws of your country, and may bring claims in your local courts.

19. General

These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Service. If any part is found unenforceable, the rest stays in effect. Our not enforcing a provision is not a waiver of it. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets. Notices to you may be sent in the app or by email.
